Terms of Service

These Terms of Service (the "Terms") govern your use of MacMater (the "Software"), a native macOS application provided by the MacMater Project ("we", "us", "our"). By downloading, installing, or using the Software, you agree to these Terms. If you do not agree, do not use the Software.
Eligibility. You must have the legal capacity to enter into a binding contract in your jurisdiction to use the Software. If you are under the age of majority in your jurisdiction, you may use the Software only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf.
License. MacMater is paid software, sold as a one-time purchase. Subject to your compliance with these Terms and your payment of the applicable fee, we grant you a personal, worldwide, non-exclusive, non-transferable, revocable license to install and use the Software on the number of Macs you own or control specified at the time of purchase. Your license is perpetual for the version available at the time of purchase and includes any minor updates we make available at no additional cost. Major upgrades may be offered as a separate paid release.
Free trial. New customers who start a yearly subscription receive a 7-day free trial; payment is deducted at the end of the trial period unless the subscription is cancelled before then. The trial does not apply to lifetime purchases, which are billed immediately. We may modify or discontinue the trial program at any time without affecting licenses already granted.
Restrictions. You may not (a) reverse engineer, decompile, or disassemble the Software, except to the extent applicable law expressly permits despite this limitation; (b) modify, adapt, or create derivative works based on the Software; (c) circumvent or attempt to circumvent any license-verification, anti-tampering, or signing mechanism; (d) redistribute, rent, lease, sublicense, or sell the Software or copies of it; or (e) remove or obscure any proprietary notices contained in the Software.
Acceptable use. You may use MacMater only on Macs you own or are otherwise authorized to administer. You may not use the Software (a) to monitor, intercept, or record the activity, communications, or input of any person without that person's informed consent; (b) to circumvent another user's security, parental controls, or device-management policies; (c) for stalkerware, employee surveillance, or any unauthorized tracking; or (d) in violation of any applicable law. We reserve the right to revoke licenses used in breach of this section.
Export and sanctions. You represent that you are not located in, or a resident or national of, any country subject to a U.S. or E.U. embargo, and that you are not on any restricted-party or sanctions list maintained by the U.S., the E.U., the U.K., or the United Nations. You agree to comply with all applicable export-control and sanctions laws when using the Software.
Updates. We may release updates, patches, or new versions of the Software at our discretion. Updates may add, change, or remove features and may include security fixes that we recommend you install promptly. These Terms apply to any update unless that update is accompanied by separate terms.
Third-party content. The Software may help you create files in formats defined by third parties—such as Microsoft Office documents or Markdown—and may launch third-party applications via "Open With". Such files and applications are governed by their respective publishers' terms, not by these Terms.
No warranty. THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED.
Beta builds. From time to time we may make beta or pre-release builds of the Software available for evaluation. Such builds are clearly labeled and may contain bugs, performance issues, or undocumented behavior, and features may change or be removed before they reach the stable release. Do not rely on a beta or pre-release build for mission-critical workflows or as the sole copy of important data.
Your indemnification. You agree to defend, indemnify, and hold harmless the MacMater Project from any third-party claim, loss, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Software in violation of these Terms or applicable law, (b) your infringement of any third party's rights through such use, or (c) any content you provide to us.
Limitation of liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE MACMATER PROJECT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SOFTWARE, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SOFTWARE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 50.
Termination. These Terms remain in effect until terminated. You may terminate them at any time by uninstalling the Software. We may terminate or suspend your license if you materially breach these Terms. Upon termination, you must stop using the Software and remove all copies. Provisions that by their nature should survive termination—including license restrictions, disclaimers, limitation of liability, indemnification, and dispute resolution—will survive.
Changes to these Terms. We may revise these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Software after a revision becomes effective constitutes acceptance of the revised Terms. If a change materially reduces your rights, we will provide reasonable notice within the application or on this page.
Governing law and your statutory rights. Nothing in these Terms limits any non-waivable rights you have under the mandatory consumer-protection laws of your country of residence, including the GDPR and UK GDPR (for EU/EEA and UK residents) and the CCPA/CPRA (for California residents). The parties will attempt in good faith to resolve any dispute through informal discussion before resorting to formal legal proceedings.
Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent, and any attempted assignment in violation of this section will be void. We may assign these Terms, in whole or in part, in connection with a merger, acquisition, reorganization, or sale of assets, on notice to you.
Severability and entire agreement. If any provision of these Terms is held to be unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force. Our failure to enforce any right under these Terms is not a waiver of that right. These Terms, together with any purchase-specific terms presented at the time of payment, constitute the entire agreement between you and us regarding the Software.
